Is medicinal cannabis legal in Australia?

Yes. Medicinal cannabis can be prescribed by any registered doctor in Australia.

Doctors must apply for approval to prescribe via the SAS-B or Authorised Prescriber pathways through the TGA. In some states, they may also require state health department approval.

Patients are advised not to drive or operate machinery while using medicinal cannabis, especially products containing THC. THC can remain detectable in your system for several days after use, even if you are not impaired.

Under current laws, driving with any detectable THC is a criminal offence. Patients should discuss the legal and safety implications with their doctor.

If you are prescribed cannabis flower, it’s recommended to use a TGA-registered vaporiser. Folium Shop gives you access to all the currently approved devices.

These devices are also available for purchase in-store at Folium Dispensary North Strathfield & Rose Bay or via our online store. Our pharmacists are available to guide you on usage.

The Therapeutic Goods Administration (TGA) also offers a helpful patient overview and video guide.

You’re not required to carry your script, but we recommend carrying a doctor’s letter if travelling, especially with THC-containing medicines.

No. Because medicinal cannabis is considered an unregistered medicine, we are legally unable to advertise products or pricing publicly. For product information, please speak with your prescribing doctor or contact our team.

Absolutely! If you’ve already been prescribed medicinal cannabis by an authorised doctor and wish to transfer your prescriptions to Folium, send us your e-Script and the Folium team will do the rest.

Some private health insurance policies may offer rebates, depending on your level of cover. Best place to start would be to contact them directly and ask the question.

If you experience serious side effects (e.g. rapid heart rate, difficulty breathing, panic attacks), seek immediate medical attention.

If you notice mild or non-urgent side effects like dizziness, dry mouth, or drowsiness, feel free to let us know or report this to your doctor for further advice.

Yes:

  • Schedule 4 (CBD): Valid for 12 months.
  • Schedule 8 (THC/flower): Valid for 6 months.

Most cannabis flower prescriptions are Schedule 8, so check the date your script was written.

After your doctor sends us your script, please allow up to 12 hours for our team to review it and contact you with the next steps.

No. Medicinal cannabis accessed via the SAS-B or Authorised Prescriber pathway is currently not listed on the PBS, and is treated as a private prescription.

Yes. If you want to switch prescribing doctors and move your care to Folium, text or call us to start your Folium journey right away.

Only your prescribing doctor can change your product or strain. Our pharmacists cannot make these changes. Once your doctor issues a new script, we’ll be happy to dispense the updated product.

  • Domestic travel: Yes – as long as the medicine remains in its original pharmacy packaging with the label attached.
  • International travel: Check with the consulate of the country you’re visiting. Each country has different rules. Visit smartraveller.gov.au for more info.
